Privacy Notice

Clappr LLC ("Clappr," "we," "us," or "our") operates Clappr.com (the "Site") and provides staffing and consulting services connecting individuals seeking employment or contract opportunities ("Candidates") with businesses seeking staffing, recruiting, or consulting services ("Clients"). This Privacy Notice explains what personal information we collect, how we use and share it, and the choices and rights available to you.

This Privacy Notice is incorporated by reference into our Terms of Use. Capitalized terms not defined here have the meaning given in the Terms of Use.

1. Who This Notice Covers

This Notice applies to Candidates, Clients, job applicants, Site visitors, and anyone else who submits personal information to Clappr through the Site, by email, or in person (e.g., an interview or intake call). It does not apply to Clappr's own employees or contractors acting in that capacity, who are covered by separate internal policies.

2. Information We Collect

a. Information You Provide Directly

• Account and contact information: name, email address, phone number, mailing address, username, and password.

• Candidate information: resume, cover letter, work history, education, professional certifications, references, salary expectations, work authorization status, and any other information you include in your profile or application.

• Client information: company name, business contact details, job or engagement descriptions, and billing/contact information for staffing or consulting services.

• Communications: messages you send us, information provided in interviews or phone screens, and any documents you upload to the Site.

b. Information Collected Automatically

• Device and usage data: IP address, browser type, operating system, referring URLs, pages viewed, and timestamps.

• Cookies and similar technologies: as described in Section 5 below.

c. Information From Other Sources

• Publicly available professional information (e.g., from LinkedIn or a professional website), if you or a Client provides it to us or we source it as part of a search.

• Information from background-check or reference-check providers, where applicable and with any required consent.

• Information from a Client about your candidacy or engagement status.

We do not knowingly collect sensitive categories of information (such as government ID numbers, health information, or precise geolocation) unless you voluntarily provide it (for example, in a resume) or it is required for a specific engagement, in which case we limit its use to that purpose.

3. How We Use Information

We use personal information to:

• create and manage Candidate and Client accounts;

• match Candidates with relevant job or engagement opportunities and match Clients with suitable Candidates;

• communicate with you about your account, an application, an opportunity, or our Services;

• provide staffing, recruiting, and consulting services, including facilitating interviews and placements;

• process payments and fulfill contractual obligations with Clients;

• operate, maintain, and improve the Site, including through analytics;

• send marketing communications about Clappr's services (you may opt out at any time, as described in Section 8);

• detect, investigate, and prevent fraud, abuse, and violations of our Terms of Use; and

• comply with legal obligations and enforce our agreements.

4. How We Share Information

We share personal information only as described below. We do not sell your personal information for money, and we do not share Candidate resumes or profiles with third parties for their own independent marketing purposes.

• With Clients: Candidate profile and resume information is shared with prospective Clients for the purpose of evaluating you for a role or engagement.

• With service providers: we use third-party vendors to host the Site, process payments, send communications, and provide analytics, under contracts that limit their use of your information to providing services to us.

• Analytics and advertising partners: we use tools such as Google Analytics and social advertising platforms (for example, Meta and LinkedIn) to understand Site usage and to advertise our services. These tools may place cookies or pixels that transmit limited technical and usage data (such as device identifiers and pages visited) to those platforms. Under California and other state privacy laws, this may be considered "sharing" for cross-context behavioral advertising even though no information is sold for money — see Section 9 for how to opt out.

• For legal reasons: we may disclose information to comply with a subpoena, court order, or other legal process, to protect the rights, property, or safety of Clappr, our users, or others, or to enforce our Terms of Use.

• Business transfers: if Clappr is involved in a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction, subject to this Notice or a successor policy.

• With your consent: for any other purpose disclosed to you at the time of collection or with your consent.

5. Cookies and Tracking Technologies

The Site uses cookies and similar technologies for the following purposes:

• Essential cookies: required for the Site to function, such as maintaining your login session.

• Analytics cookies: help us understand how visitors use the Site (for example, Google Analytics) so we can improve it.

• Advertising cookies/pixels: used by us and our advertising partners (for example, a Meta Pixel or LinkedIn Insight Tag) to measure the effectiveness of recruiting and marketing campaigns and to show Clappr ads on other sites.

You can control cookies through your browser settings, including blocking or deleting them; note that blocking essential cookies may affect Site functionality. Where required by law, we will request your consent before placing non-essential cookies and will honor your choice.

6. Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Notice, including maintaining your candidate profile for future opportunities, meeting our contractual obligations to Clients, and complying with legal, accounting, or reporting requirements. You may request deletion of your account and associated information at any time, as described in Section 9; we will honor such requests except where we are required or permitted by law to retain certain information.

7. Data Security

We use administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If you have reason to believe your account has been compromised, contact us immediately at info@Clappr.com.

8. Your Choices

• Marketing communications: you may opt out of marketing emails by using the unsubscribe link in any such email or by contacting us at info@Clappr.com. You will still receive transactional communications related to your account or an active application/engagement.

• Account information: you may review, correct, or update your account information by logging into your account or by contacting us.

• Cookies: see Section 5 above.

9. Your Privacy Rights

Depending on where you live, you may have the right to request access to, correction of, or deletion of your personal information, to obtain a copy of the information we hold about you, or to opt out of certain uses of your information. To exercise any of these rights, email info@Clappr.com with your request; we may need to verify your identity before completing it. We will not discriminate against you for exercising your privacy rights.

California Residents

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), gives you the right to:

• know what categories and specific pieces of personal information we have collected about you, and the sources, purposes, and third parties involved;

• request deletion of your personal information, subject to certain exceptions;

• correct inaccurate personal information;

• opt out of the "sale" or "sharing" of your personal information (see Section 4 regarding advertising cookies/pixels, which may qualify as "sharing" under this law); and

• limit the use of sensitive personal information, to the extent we collect it.

To exercise these rights, email info@Clappr.com or use any opt-out mechanism made available on the Site. We honor recognized opt-out preference signals, such as the Global Privacy Control (GPC), where technically applicable.

Other U.S. State Residents

If you reside in a state with a comprehensive privacy law (such as Virginia, Colorado, Connecticut, Utah, Oregon, or others as they take effect), you may have similar rights to access, correct, delete, or obtain a copy of your personal information, and to opt out of targeted advertising. European Economic Area, UK, and Switzerland

If you are located in the EEA, UK, or Switzerland, we process personal information on the following legal bases: performance of a contract (e.g., providing staffing services you requested), our legitimate interests (e.g., operating and improving the Site, preventing fraud), your consent (e.g., certain cookies or marketing), and compliance with legal obligations. You have the right to access, correct, delete, restrict, or port your personal information, and to object to certain processing. 10. Children's Privacy

The Site is intended for individuals who are at least 18 years old and is not directed to children. We do not knowingly collect personal information from children under 13 (or the applicable age of digital consent in your jurisdiction). If you believe a child has provided us with personal information, contact us at info @ Clappr.com and we will take appropriate steps to delete it.

11. Third-Party Links

The Site may link to third-party websites, including job boards, professional networking sites, or Client career pages. This Notice does not apply to those third-party sites, and we encourage you to review their privacy practices independently.

12. Changes to This Notice

We may update this Privacy Notice from time to time. If we make material changes, we will revise the "Effective Date" above and, where appropriate, provide additional notice. Your continued use of the Site after changes take effect constitutes acceptance of the updated Notice.
